Terms of Use

Welcome to Muster, operated by Warr Studios Ltd. (“us,” “we,” the “Company” or “Muster”). This document sets out the terms and conditions (“Terms of Use”) under which you may use Muster.

1. Acceptance of Terms of Use Agreement.

By creating a Muster account or by using the Muster app, here referred to as our “Service”, whether through a mobile device, mobile application or computer, you agree to be bound by (i) these Terms of Use, (ii) our Privacy Policy and to abide by our Safety Advice. If you do not accept and agree to be bound by all of the terms, collectively the “Agreement”, you must not use Muster.

For the purposes of these Terms of Use, the terms “you” and “your” refer to the legal person or entity using the Service; including, but not limited to, you and/or the business, company, or entity which you represent, together with any employees, agents, representative, or authorized third parties.

You acknowledge that you have read, understood, and agree to be bound by these Terms of Use in their entirety. Please review the Terms of Use, Privacy Policy and Safety Advice before using the Service. If you do not satisfy these conditions, subject to this Agreement, you may not use the Service in any way or for any purpose.

We may make changes to this Agreement and to the Services from time to time. We may do this for a variety of reasons including to reflect changes in or requirements of the law, new features, or changes in business practices. The most recent version is the version that applies. If the changes include material changes that affect your rights or obligations, we will notify you in advance of the changes by reasonable means, which could include notification through the Service or via email. If you continue to use the Service after the changes become effective, then you agree to the revised Agreement.

2. Eligibility.

You must be at least 18 years of age to create an account on Muster and use the Service. By creating an account and using the Service, you represent and warrant that:
– you can form a binding contract with Muster.
– you are not a person who is barred from using the Service under the laws of the United Kingdom or any other applicable jurisdiction.
– you will comply with this Agreement and all applicable local, national and international laws, rules and regulations, and
– you have never been convicted of a felony and that you are not required to register as a sex offender with any state, federal or local sex offender registry.

3. Your Account.

In order to use Muster, you must sign in using your Facebook login. If you do so, you authorize us to access and use certain Facebook account information, including but not limited to your public Facebook profile and information about Facebook friends you share in common with other Muster users. For more information regarding the information we collect from you and how it may be used, please consult our Privacy Policy.

You are solely responsible for the security of any sensitive information associated with your login credentials and Muster account. Furthermore, you are solely responsible for all activities that occur under those credentials.

4. Modifying the Service and Termination.

We are continually striving to improve the Service, and add new additional functionality to Muster. We hope you find these additions useful and engaging. Adding more functionality may mean that we also occasionally remove some features or enhancements. These actions do not materially affect your rights or obligations, especially pertaining to this Agreement. We may not provide you with notice before taking them.

In certain eventualities we may suspend the Service entirely or indefinitely, in which event we will notify you in advance, unless extenuating circumstances such as Safety or Security prohibit us from doing so. You may terminate your account at any time, for any reason.

We may terminate your account at any time, for any reason, without notice if we believe that you have violated this Agreement.

5. Safety; Interactions with Other Muster Users.

As a condition of this Agreement, you state that you will not use the Service for any purpose that is unlawful or prohibited by these Terms of Use. You also agree to reimburse the Company for any damage, loss, cost or expense we incur, including, but not limited to any legal fees resulting from your use of the Service.

Muster endeavours to encourage a respectful and safe community environment, and user experience, but we are not responsible for the conduct of any user on or off the Service. You agree to exercise caution in all interactions with other users, particularly in the cases of direct communication and in-person meetings. In addition you state that you have read and understood the Muster Safety Advice prior to making use of the Service.

7. Rights Muster Grants You.

Muster grants you a personal, worldwide, royalty-free, non-assignable, nonexclusive, revocable, and non-sublicensable license to access and use the Service. This license is for the sole purpose of letting you use and enjoy the Service and its benefits as intended by Muster and permitted by this Agreement. Therefore, you agree not to:
– use the Service or any content contained in the Service for any commercial purposes without our written consent.
– copy, modify, transmit, create any derivative works from, make use of, or reproduce in any way any copyrighted material, images, trademarks, trade names, service marks, or other intellectual property, content or proprietary information accessible through the Service without Muster’s prior written consent. express or imply that any statements you make are endorsed by Muster.
– use any robot, bot, spider, crawler, scraper, site search/retrieval application, proxy or other manual or automatic device, method or process to access, retrieve, index, “data mine,” or in any way reproduce or circumvent the navigational structure or presentation of the Service or its contents.
– use the Service in any way that could interfere with, disrupt or negatively affect the Service or the servers or networks connected to the Service.
– upload viruses or other malicious code or otherwise compromise the security of the Service.
forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted to or through the Service.
– “frame” or “mirror” any part of the Service without Muster’s prior written authorization.
use meta tags or code or other devices containing any reference to Muster or the Service (or any trademark, trade name, service mark, logo or slogan of Muster) to direct any person to any other website for any purpose.
– modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Service, or cause others to do so.
– use or develop any third-party applications that interact with the Service or other users’ Content or information without our written consent.
– use, access, or publish the Muster application programming interface without our written consent.
– probe, scan or test the vulnerability of our Service or any system or network.
– encourage or promote any activity that violates this Agreement.

The Company may investigate and take any available legal action in response to illegal and/ or unauthorized uses of the Service, including termination of your account. We reserve the rights, in its sole discretion, to terminate your access to the Service, or any portion thereof at any time, without notice.

Any software that we provide you may automatically download and install upgrades, updates, or other new features. You may be able to adjust these automatic downloads through your device’s settings.

8. Rights you Grant Muster.

By creating an account, you grant to Muster a worldwide, transferable, sub-licensable, royalty-free, right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, modify and distribute information you authorize us to access from Facebook, as well as any information you post, upload, display or otherwise make available (collectively, “post”) on the Service or transmit to other users (collectively, “Content”). Our license to your Content is subject to your rights under applicable law (for example laws regarding personal data protection to the extent any Content contains personal information as defined by those laws) and is for the limited purpose of operating, developing, providing, and improving the Service and researching and developing new ones. You agree that any Content you place or that you authorize us to place on the Service may be viewed by other users and may be viewed by any person visiting or participating in the Service.

You agree that all information that you submit upon creation of your account, including information submitted from your Facebook account, is accurate and truthful and you have the right to post the Content on the Service and grant the license to Muster detailed above.

You understand and agree that we may monitor or review any Content you post as part of the Service. We may delete any Content, in whole or in part, that in our sole judgment violates this Agreement or may harm the reputation of the Service.

You acknowledge that we reserve the right to immediately terminate your account in the event that you fail to be both respectful and kind when dealing with any Muster representative. If we deem you behaviour to be, at any time, unsavoury, threatening or offensive we will suspend your usage of the Service. You agree that Muster may access, preserve and disclose your account information and Content if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary, such as to: (i) comply with legal process; (ii) enforce this Agreement; (iii) respond to claims that any Content violates the rights of third parties; (iv) respond to your requests for customer service; or (v) protect the rights, property or personal safety of the Company or any other person.

We hope to have a constructive and happy relationship with you as a user, and in consideration for Muster providing you with the Service, you agree that we, our affiliates, and any third-party partners may place advertising and other marketing devices on the Service. By submitting suggestions and/or feedback regarding the Service or Muster community, you agree that Muster may use and share this information for any purpose, without compensating you.

9. Community Rules.

By using the Service, you agree that you will not:
– use the Service for any purpose that is illegal or prohibited by this Agreement. spam, solicit money from or defraud any users.
– impersonate any person or entity or post any images of another person without his or her permission.
– bully, “stalk,” intimidate, harass or defame any person.
– post any Content that violates or infringes anyone’s rights, including rights of publicity, privacy, copyright, trademark or other intellectual property or contract right.
– post any Content that is hate speech, threatening, sexually explicit or pornographic; incites violence; or contains nudity or graphic or gratuitous violence.
– solicit passwords for any purpose, or personal identifying information for commercial or unlawful purposes from other users or disseminate another person’s personal information without his or her permission.
– use another user’s account.
– create another account if we have already terminated your account, unless you have our permission. act at all times in accordance with our Safety Advice.

10. Other Users’ Content.

Although Muster reserves the right to review and remove Content that violates this Agreement, such Content is the sole responsibility of the user who posts it, and Muster cannot guarantee that all Content will comply with this Agreement. If you encounter Content on the Service that violates this Agreement, please report via help@musterapp.co.uk

Privacy Policy

Muster, (“Muster”, “we”, “us” or “the Company”) respects both the privacy of its users as well as their desire to fully understand and choose how collected information may be used.

This Privacy Policy describes the information that we collect through Muster, the way in which that information is used, how it may be shared, and the overall choices that users have about these disclosures and uses.

Please do read this Privacy Policy carefully when using Muster. With respect to your continued access to and use of Muster, you are accepting the practices explained in this Privacy Policy.

The info we collect

We may collect Personal Information, including Sensitive Data and other information.

“Personal Information” is information which may be individually identifiable such that it would allow us to determine your identity, and contact you, as a specific living person.

“Sensitive Data” includes information, in comments or other content (for example; images, profiles, video) which, once willingly provided, may reveal a person’s ethnicity, nationality, “gender”, religion and/or sexual orientation. By willingly providing Sensitive Data, you are consenting to the collection, use and potential disclosure of this data as permitted by all applicable privacy laws.

We may collect Geolocation data with your specific consent and if you enable the GPS Co-ordinate or Geolocation feature as part of Muster. As well as a device identifier, MAC address, Internet Protocol (IP ) address.

We may collect all of the above information through the Muster mobile application. By using Muster, you are authorising us to gather, parse and retain data related specifically to the provision of the Muster service.

The info you’re providing

By registering to use Muster with your Facebook account, you authorize us to collect a few different pieces of Facebook Account Information. This may include your Public Facebook Profile (in accordance with your Privacy Settings within Facebook), your email address, interests, likes, “gender”, date-of-birth, education history, relationship interests, current city of residence, profile photos, descriptions, friends and information about mutual friends who also use Muster.

We will also collection some location information from your device when you use Muster.

We may also be responsible for willingly providing some pieces of Personal Information as described above. This may include your full name, address, email address and telephone number.

We make use of various technologies when collecting information from your device and about your activities on our Service. Some information may be collected automatically from your device.

How we use the info

We may use the information we collect to do several things;
– Improve and continue to deliver our Service and manage our business.
– Manage your account on Muster and provide you with customer support.
– Research and analyse your use of Muster, and what other services or products you may be interested in. – Communicate with you.
– Implement, display and track content that you may find specifically interesting and relevant (advertising or otherwise).
– Enforce or exercise any element of our Terms and Conditions or Safety Advice.

With whom we share info

Once you’ve registered as a user on Muster, your Muster profile will be viewable by other users. They will be able to view information have have provided and made available through the Service. This may include information provided directly to us through Facebook; including Facebook Profile Photos, Your First Name, Your approximate location and common Facebook friends you share.

We do not share Personal Information with other parties, except as indicated in this Privacy Policy. We will inform you of such instances and give you the chance to opt out of having Personal Information shared.

We may share Personal Information;
– In response to an investigative demand, a court order or other request for cooperation from a law enforcement or other government agency.
– To establish or exercise our legal rights, or defend against legal claims
– When we believe that disclosure of such information is appropriate in connection with efforts to prevent, investigate or otherwise take actions upon an illegal activity.
– To fulfil other services such as providing customer service, marketing assistance and performing business and sales analysis.

How we handle aggregated and non-personal info

We may use and share non-personal information. We may share it with third parties to deliver targeted advertising on Muster, as well as to analyse and report on advertising that you see.

We may also share aggregated, non-personal information with third parties, including investors, advisors and advertisers for general business purposes.

We may share Geolocation information in de-identified form with third parties for the above purposes.

How to access your info

Within your Muster account you have the ability to review and update your personal information. Applicable privacy laws may allow you the right to access and amend the personal information that we hold. Please do not hesitate to contact privacy@musterapp.co.uk should you have a request or any concerns about the management of your data. We will endeavour to respond to all requests as quickly as possible and within the time allowed by all applicable privacy laws.

How long we keep your info

We will retain information only for as long as it is needed for any legitimate business purpose, as well as being permitted by any applicable law.

Should you close your account, we will retain some information for both analytical purposes and recordkeeping; mostly to prevent fraud and enforce our Terms and Conditions.

How you can make choices about your info

You may always choose not to provide us with certain pieces of information. This may sometimes result in you being unable to use certain parts of the Muster service.

You may always contact us about your data. Access is subject to applicable privacy laws. We will update this Privacy Policy in accordance with changes to the law, our own data collection practices and some features of Muster.

All changes to this policy will be clearly stated and a “Last Updated” date applied.

Safety Advice

Muster is about community. It is focused around bringing people together; people who share the same passions and interests.

Meeting new gamers is an exciting and wonderful prospect, but as with everything else in this world, it’s often best to exercise some caution. Your safety is incredibly important to us, and likewise your enjoyment of Muster as a Platform. We therefore implore you to be careful and to take these Safety Guidelines into account when making use of the app.

Please protect your finances and Personal Information at all times.

Do not respond to enquiries or other communication regarding money, wire transfers, bank account details or bill payments. Muster is about getting the most out of gaming in the real-world, not about money.

Please protect your Personal Information

Do not disclose or discuss any sensitive personal information at any time when using Muster. This includes, but is not limited to your; passport details, national security information, sensitive e-mail or mobile phone numbers, driving license information or other such details.

The same applies to Online details including passwords and usernames, as well as other long-in information; including Security Question answers.

Please report suspicious, malicious or pernicious behaviour

Tabletop gamers are often the finest people you’ll meet; but we do still ask that you report any evidence or incidences of un-to-ward behaviour. This includes, but is not limited to; requests for personal details, requests for explicit photographs, requests for other explicit content, image or text based harassment, fraudulent usage or registration and any cases of spamming or other solicitation.

It is not permitted to behave in this fashion whilst using the Muster Platform; please report any information about incidences of misuse to us immediately at help@musterapp.co.uk

Please behave responsibly whilst Offline and meeting with other Muster gamers

It’s a fantastic prospect; connecting to a whole world of gamers like yourself through a community-building Platform. Yet it’s still necessary to exercise caution when out there in the world.

Meeting new gamers should be based on clear and honest communication. Muster is a tool to support responsible, interested and reasonable gamers everywhere. If you are not one of these gamers, you must not make use of Muster.

Some people can be highly manipulative, and often communicate in a way that seems honest and endearing. It is up to you to research other users, and to perform due diligence when organising to meet. This may include, but is not limited to; search engine searches, asking framing safety questions, seeing if you already have mutual friends or gaming contacts in common. Please endeavour to protect yourself and your sensitive information at all times when using Muster; and please report any information about incidences of misuse to us immediately at help@musterapp.co.uk

Please be careful when conducting your meeting with any other Muster gamers

Always, always, without exception, meet with other users in a public place that you know well. Remain in public for the duration of your meeting and ensure that you stay alert and conscious of your surroundings.

Muster will put you in touch with some excellent opponents, friends and peers, but if you feel, at any point, uncomfortable or under pressure during your meeting with another Muster gamer, leave immediately and please report any information about incidences of such misuse to us immediately at help@musterapp.co.uk citing the user and any relevant information.

It is also vital that you transport yourself to and from your meeting, having let someone else, a friend or family member, know where you are going and when you expect to return. Remain in contact with others during your games. Stay independent and in control of your possessions and situation as far as possible.

Please be open and honest at all times when using Muster, we want to encourage the best out of our users and build a fantastic community that enjoys meeting and playing with one another.

We recommend that anything which might impair your judgement, ability to make decisions or potentially put you in danger should be avoided whilst meeting with other Muster gamers.
